Preventing the Evictions of Renters as a Result of Foreclosu
Description: The growing economic crisis and foreclosures in the Commonwealth are taking a toll, not only on home owners, but on renters as well. According to the National Low Income Housing Coalition, about 40 percent of people facing eviction from foreclosure in the United States are renters. Currently, Massachusetts laws provide tenants whose landlord’s property has been foreclosed some protection from immediate eviction, but not enough. If a property is foreclosed and the lender or new owner does not want any current tenants, the tenant is entitled to at least 30 days written notice before their lease can be terminated. However, given the number of foreclosures in the Commonwealth, and the current economic times, it can still prove extremely difficult for victims of foreclosure-related evictions to find new, affordable residences for themselves and their families. H.1232 would allow renters who are being evicted through no fault of their own to remain in their homes. Specifically, H.1232 would make it unlawful to evict tenants of a foreclosed property simply because the building’s ownership has changed, and calls for individual sanctions for each unlawful eviction attempt.

I am writing to urge you to support H. 1232, “An Act to protect tenants in foreclosed properties from evictions,” which is currently before the Joint Committee on Housing. Aimed at protecting renters in the Commonwealth from the foreclosure crisis, this bill would prevent new owners of previously foreclosed buildings from evicting tenants simply because they have assumed new ownership. In 2008, there were more than 12,000 foreclosure deeds in Massachusetts. Because of the broad impact that these foreclosures have on families all across the Commonwealth, new legal protections for tenants impacted by foreclosures is greatly needed. The tenants of foreclosed properties have done nothing wrong and, as such, they do not deserve to suffer unnecessary expulsion from their residences because of the economic hardship experienced by their landlord. H. 1232 would make it unlawful to evict tenants simply because ownership of a building has changed, and calls for individual sanctions for each unlawful eviction attempt. I urge you to support H. 1232 – protect responsible renters from foreclosure induced eviction!
